This young man was the beneficiary of an I-130 petition filed by his Mother. We first learned about his case many years ago, He was brought to the USA as a child. The family was told by many Immigration Consultants that there was no remedy for him until his priority date was current. We were able to obtain an employment authorization card after filing an I-817 for Family Unity that was approved . Years later he was recommended to use a Las Vegas attorney to renew his I-817 s...tatus. Unfortunately the attorney's assistants completed the wrong paperwork and his status was terminated and he was subject to possible removal. At this point, he again asked for our assistance. We made contact with the attorney and recovered his monies and then resubmitted the correct paperwork and his Family Unity status was again approved and an employment authorization card issued. As if his problems had not already been so many, His Mother, the Petitioner died months before his priority date came current. He was again informed by local immigration consultants that there was no relief and his petition died with her. With the assistance of our Arizona Office Assistant's, we were able to submit a humanitarian revalidation of the I-130 filed by his Deceased Parent. This youngman is now in the adjustment of status process and this weekend received his new employment authorization card. His I-551 card will follow soon at which point he will be a Lawful Permanent Resident of the United States.. Congratulations Alex

For your information. We had a client whose parent had filed an I-130 in 1997. The I-130 was later approved. However the parent petitioner died 6 months before the priority date came current. In the past the case would have been considered by most to then be invalid after the death of the petitioner. This is not necessarily true. As of 2009 Section 204(i) indicates action can be taken to attempt to re-validated the I-130 in question. We submitted such a case and were just... informed that the I-130 has in fact been re-validated and the adjustment of status can be filed. If you or anyone you know has had such an occurrence of a death of a petitioner after the I-130 had already been approved, It would be wise to seek the assistance of an attorney and not a Notary or Tax person who fills out immigration paperwork. This is too technical a legal situation to be left in the wrong hands. ------------------------------------------------------------------------------ Para su información. Tuvimos un cliente que su padre había solicitado la forma I-130 en 1997. La cual fue aprovada más tarde. Esto es demasiado técnico una situación jurídica que se deja en manos equivocadas.
